Montana Retirement Asset Protection Laws
Montana laws protect the following retirement assets from creditors:
- right to receive benefits from or interest in a private or government retirement, pension, stock-bonus, profit-sharing, annuity, or similar plan or contract, except for contributions made within one year pre-petition which exceed 15 percent of the debtor's gross income for that one-year period;
- public employees' retirement system benefits;
- teachers' retirement system benefits;
- sheriffs' retirement system benefits;
- wardens' retirement system benefits;
- highway patrol retirement system benefits;
- municipal and locally funded police officers' retirement system benefits;
- firefighters' unified retirement system benefits; and
- judges retirement system benefits.
